For Services users:
You own your data: The information you collect via your promotions is private, and the data is yours. You have full control over the data you collect, and how you use it. We will never sell your data to anyone else, and the data we collect on your behalf is never used by us other than to provide it directly to you. However, if requested, we must obey information requests from government agencies and regulators, court orders, and other legal and regulatory processes that may involve the disclosure of your personal or the information collected from your promotions.
We never contact your Participants: We will never contact the Participants of your promotions, or otherwise use their data in anyway other than to provide it directly to you, unless the participants contact us requesting help or if you hire us to act as sweepstakes administrators and in that case we will contact winners or potential winners for the purpose of fulfilling the service. If you use some features of our Services, such as our email or text (SMS) notifications feature, we will only contact your Participants on your behalf to deliver an email or text (SMS) message to them about your promotion. Your Participants are otherwise not added to our own internal email lists, marketing lists, or contacted about anything other than as it relates to your promotion and the features you use through our Services.
You are the data controller of Participant's information: If you are using our Services to execute promotions, then under EU regulations and GDPR, your use of our Services classifies you as the data controller. As such, you are responsible for ensuring that you comply with the GDPR and are required to use the appropriate compliance statements regarding privacy and data protection and responsible for honoring participant’s requests under EU regulations when using our Services.
Sweeppea is also the data controller: When you use our Services, you are creating an account and promotions. We collect only the information we need from you to communicate with you and deliver our services. We will never sell your data, or otherwise use your data other than to provide you with information regarding your account, and or, your use of our Services.
Information we collect from you: To use the Services, we will collect registration information like, first and last name, email address, and mobile number, and billing information like credit card number, expiration date, and Card Verification Value (CVV).
Sweeppea is the data processor: By using our Services, you are able to collect Participant's information and also comply with the appropriate data processing regulations.
If you are entering the promotion as a Participant:
We never sell, rent, or share your data: The information you provide through a promotion is provided directly to the creator of that promotion. Sweeppea acts as a processor on behalf of its customer to collect that data and provide it to them. We do not sell, share, or use your data in anyway other than to provide it to the customer whose promotion you may have entered. If you have questions regarding your information and how it is being used, please contact the creator of the promotion.
Our customers administer and control promotions: It is important to understand that we provide a service that allows our customers to create, administer, and control sweepstakes contests or marketing promotions. We process the data collected through these promotions on behalf of our customers, and we host the services and platform for them. If you have questions regarding a specific promotion, please contact the creator of the promotion.
Participant information provided to us: The information we collect from you on behalf of our customers will change depending on the promotion. At a minimum, we will collect your email address or your mobile phone number, however, the creator of the promotion may request more information from you.
Information collected using tracking technologies: If you enter a promotion, we will automatically collect information from you including device information like web browser and operating system, usage information like IP address, pixels, web beacons, clear gifs, cookies, and referral information like the referring URL.
Rights of European Union Customers and Participants: Under General Data Protection Regulation (GDPR) and other European Union (EU) regulations, you have rights in regards to the handling of your personal information. At any time, customers may contact the data processor (Momares, LLC d.b.a. Sweeppea) about these rights. As a Participant, you may contact the data controller (the individual or company who is using our Services to run promotions) about your rights. We collect information about you when you provide it directly to us through the use of our Services, and when other sources provide it to us, such as when you are visiting our website.
Information you provide when using our Services:
Personally identifiable information (PII)
PII is information that identifies you as an individual. We ask you to provide us with PII when you create an account or complete a contact form on our site. As a visitor, you can visit our website to learn about Sweeppea and the Services we offer without providing us with any PII. You can create an account by providing us with your name, email address, and mobile phone. We may ask you for additional information, such as your address and payment information, based how you use your account. If you provide us with payment information, please note that we store and encrypt your payment source information on our servers to process your payments. However, you understand and agree that we do not control, nor can we be liable for the acts of third parties. If you see what you believe to be fraudulent transactions regarding our website, please contact us immediately. We will make reasonable efforts to work with you and authorities to help resolve such issues.
Content you provide when using our Services
Through your use of our Services, we collect content that you submit to us when creating a promotion. For example, you may provide or create content like; images, links, files, descriptions, and official rules.
Participant Personally identifiable information (PII)
To offer our services, we collect data (including PII), from consumers (“Participants”) that are participating in sweepstakes, contests, and other promotions that you conduct using our Services. If you are visiting this Site as a Participant, we will collect such elements of PII as may be requested by the customer that is offering the promotion.

Using the Services
When you use any of our Services, or if we use our Services on your behalf, we collect information when you interact with the features of the Services. This information includes features you use when creating promotions. For example, when you create a sweepstakes promotion, add images, content, and configure your settings, we track all the options being added or removed to know what to show when your promotion is being set up. Additionally, we use this information to offer customer support when requested.
If you are a Participant in a promotion, we collect information when you interact with the promotion you entered. For example, if you complete an entry page form, we track and save your information to designate you as a sweepstakes promotion participant.
Use of the information collected
The information we collect through your use of our Services depends upon how you use the Services, which of our Services or plans you use, and any preferences you have selected.
How We Use Your Personally Identifiable Information (PII)
We use your PII to interact with you to provide our Services and contact you on a personal level. For example, we may send you an email to the email address you provided for creating an account. We may send service alerts regarding your use of our Services. We may also use PII you provide to customize our Services, and or for safety and security purposes to verify account activity, or to monitor suspicious activity. Additionally, we may send you promotional emails, unless you have opted out (unsubscribed) from receiving such information. You can update your contact preferences at any time in your account. You can opt-out of promotional messages. You cannot opt-out of receiving service alerts.
How We Use Participant Personally Identifiable Information (PII)
How we share information
- If you are a Participant, we will share your PII with the company sponsoring the sweepstakes, contest, or other promotion(s) you entered.
- We contract with other companies and individuals to perform functions or services on our behalf, such website hosting, data storage and analysis, sending email messages, processing payments, and other services. We share your PII with such third parties as may be required to perform their functions. We’ll share as much of your information with these parties as may be required for them to deliver their services.
- If requested or required by government agencies and regulators, court orders, and other legal and regulatory processes that may involve the disclosure of your personal information. Sweeppea may also disclose your PII to exercise or protect legal rights or defend against legal claims.
- If we choose to buy or sell assets. In these asset transfers, customer information, including PII, is typically transferred. If all, a portion of or significantly all our business assets were to be acquired, merged into a business, or if we go into bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. You acknowledge that such transfers may occur.
- We reserve the right to disclose personally identifiable information and/or non-personally-identifiable information if in good faith, is appropriate or necessary to enforce the Terms of Service, to take precautions against liability, to investigate and defend itself against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our Servcies, and to protect the rights, property, or personal safety of our users or others.

How we protect information
Unfortunately, the transmission of information via the internet is not 100% completely secure, and we cannot completely guarantee the security of any information we may have collected from or about you. In addition, we have no control over the security of other web sites on the Internet that you may visit even when a link may appear on those web sites from our Site. Data Retention, deletion and destruction
If you cancel your Sweeppea account, we will delete all data, including PII collected from Participants, as well as all promotions after 72 hours.
We reserve the right to retain PII and other information we collect from you for as long as we deem necessary to satisfy a business purpose. If you unsubscribe from our email list, we will move your email to an unsubscribed email file and you will no longer receive emails from us.
If you continue your subscription to our Services, all data is retained for the duration of the account, unless you delete any PII collected from Participants, or you delete any promotions from your account.
Accessing and controlling your information
As a customer, you may delete or edit elements of your PII by logging in to your account and visiting My Account tabs via our Services. You may edit, update, and or delete promotion information and PII collected from Participants using the features available to you through the use of our Services. You can always unsubscribe from receiving non-account related emails by clicking on the unsubscribe link included with every email and/or updating your email communication preferences in you account.
To comply with GDPR and other EU regulations, and to help our customers comply, we have provided features via our Services to help with the following rights, which include: the right to be informed, right of access, right to rectification, right to erasure, right to restrict processing, right to data portability, right to object and rights in relation to automated decision making and profiling.

Browser “"Do Not Track" requests
We use software that enable us and third parties to track your online visits to our website(s). We do not respond to browser “Do Not Track” requests, and you can prevent certain online tracking applications like Google Analytics from identifying you on return visits to our website by disabling cookies on your browser settings.
California Consumer Privacy Act (CCPA)
The Act, also known as 2020 California Proposition 24, expands existing data privacy laws by allowing consumers greater control of their personal data. Under the CCPA, Sweeppea is considered a service provider who collects information on behalf of businesses. Sweeppea does not sell your personal information. You may request that businesses disclose to you what personal information they have collected, used, shared, or sold about you. You have the right to ask businesses to delete any personal information that has been collected from you, though there may be some exceptions. You also have the right to opt out of the sale of your personal information from businesses who may sell it.
Children Under 13
Children under the age of 13 are not permitted to use our Services. We do not knowingly collect any personal information from children under 13. If we learn that a person under 13 years of age is trying to register for our Services, we will attempt to delete the information provided as soon as possible.
Persons that reside outside of the United States
If you provide us with your PII when you create an account, or when you enter a customer’s promotion, please note that your PII data will be stored in the United States, which may not require or meet the level of protection required in your country of residence.
